Attorney Kenneth R. Bailey of the Bailey Legal Group won in the Sixth District Court of Appeals.
The government appealed Judge Lux's suppression of a breath test in an OVI case alleging the calibration failures were too attenuated from the subject's breath test. Judge Lux ruled he simply had no faith in the breath test result, and the Sixth District Court of Appeals agreed.
Many of these machines are twenty years old or older, and they should be challenged.
